In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

I am from Ireland and its for a Multi national manager or executive. My attorney told me that form her experience it takes 4-6 weeks after approval of the I-140 as the visa numbers are current. Bit apprehensive to give the company as I dont see a need for anyone to know this info???

Can I apply for H1B stamp on the same H1B approved petition (not yet extended since I still have a year remaining on it) that I had when I returned on AP last year instead of H1B stamp? The reason to apply for H1B stamp this time is because of AP delay. I am hoping this memo says yes. Any thoughts?
Since the AP entry does not invalidate the approved H1B (or L-1) petition, the foreign national potentially could regain H (or L) status by traveling abroad and reentering with a valid H (or L) visa, and obtaining an H (or L) notation on the I-94 card at the port of entry. In these circumstances, the H (or L) status will be reinstated, giving one the benefit of continuing in that status for a length of time even if the I-485 ultimately is denied. Thus, when one wishes to maintain H1B (or L-1) status, which is often the case, this still may be accomplished, even if AP is used for entry at some stage in the process.

You'd have to reapply for I140 for the new company. The one you had approved for the old company will not be valid for the new company.

Hi,
On the USCIS website, it mentioned "normal processing time" in the following statement. I am wondering what is the normal processing time for I-485. I can't find it. When the published processing time is current for a case, how long it will take for a case to be approved?
My case suddenly becomes current for a month with the sudden forward movement of the processing time. I am wondering how long should I wait before I contact USCIS about my case if I do not hear anything from them.
When is name check initiated? When the case is received or when the case processing time becomes current?

Here's an example of my first outing with my new lens, shooting birds in a nature preserve bird feeder area. I used a monopod on a cloudy day. I didn't realize how quick those little buggers can be. I shot manual and found the autofocus to be irritating at times. Any feedback on doing this kind of shooting would be appreciated.

Use the AR 11 online process to change address do it seperately for yourself and your wife. When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.

We, July 2 filers, just got our receipts. So you are not that bad. After 90 days wait, you are entitled to ask for an investigation, but, as it appears, USCIS is not yet fully finished with all the receipts for July-Aug filers. They said that they will be done with it by month end. You may want to wait until then.

My I-140 is pending, and my H1B renewal is also pending. Can I travel to India? If yes, what will I show as proof at re-entry?
How will it be for my wife? She is on F1 going on to OPT and a pending I-485 linked to my I-140 application.

I suggest you do premium processing of H1 extension or wait until approval. As far as your wife is concerned, I am not clear if she has a visa stamp. If not she can enter on AP.

The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf). The schools listed have all been certified to participate in the program.
The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.
