Hi guru�s,
Need some help, I was in US working for a consulting company and a good client for 4 years then due to some family issues I had to return back to India in the beginning of last year �08. I and my wife has visa stamped in passport valid till the end of this year. Now I want to come back to US and I am not sure if I can enter US again with the same visa as I do not have paystub from my employer for last 1.5 years.
During this 1.5 years I started my own business and tried various options but didn�t work out well so want to return back to US and during this time we had a son who doesn�t have a visa. Does any body know how I can return back to US, are they really strict at port of entry and would not let me in without a project. I don�t have a project right now and will look for it once I am in US. Any input would be very helpful.

dude.. are you talking about renewing your AP or EAD?
I dont think there's any such thing as renewing an I-140.

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
2. what are the consequences of using AP within 180 days after filing for 485 ?
3. Is AP and AC21 related ? [brother, sister , cousin :) ]

I am graduate student in Clinical Psychology. I am going to be working for a state employer during summer. This is mandatory for my program and I will receive 6 credits for it by the end of summer. However, due to some graduate school rules, I will have less than minimum credits to take during the Fall '10 and Spring '11 semesters. I was wondering if I could go ahead and work on CPT during summer (the employment is not paid), but register for those credits during Fall '10 and Spring '11 (breaking it up into 3 credits each) which will ensure my minimum registration.
Also, can I apply for CPT during a semester when I have taken minimum credits required and I am a TA (full 20 hours)?

You need ask your school officials regarding their CPT policy. It varies from school to school.

Yes. You will get all the tax rebates. I remember getting the rebate check after 2001.

Guys:
Our( my wife of H4 and me on H1) currently have visas stamped till end of Feb'07.
Now, I am going to file for my extension.
The question is that if my wife travels out of US before end of Feb, according to my lawyer we do not need to file foe her extension.
When she is to come back the lawyer says that she would get her H4 visa based on either my pending application or approved extension.
Is this possible, that without filing for her extension she can get her H4 in Delhi stamped, based on my extension application..??
Please share your thoughts.. I am perplexed..!!!

Looks like the lawyer gave you half baked suggetion.
If she is leaving the country before her current I94 expiry then you do not need to file extension for her, but she needs to get H4 visa stamped before entering US, she can get a Visa stamp only with your H1 approval document only and not the extension pending application, which means she cannot get back into teh country until your H1 extension approval

When i travelled using AP i had Just One copy and when IO asked for rest i said they are with the attorney.
The IO said i should carry all AP copies and can reuse the one which is stamped.

Do not do that !! Its a part of the initial evidence andyour application can be rejected based on that.
You can ask her parents to take an afidavit, scan it and send it to u ....

What is the minimum requirement for EB2? From what I read, it's BS+5yrs, or MS+1yr.
1. Is there a rule that the experience should have been gained outside of the US?
2. Is there a rule that the number of years experience should be from an employer other than the petitioning employer?

I got my EB3 I-140 approval after I applied my I-485 with later PD EB2. Our lawyer sent a letter to USCIS, but there is no confirmation from USCIS. Please let me know, if there is any way to check the PD.

A thought about meeting the Senators/Congressmen.
Should we not meet the new senators and congressmen now, BEFORE they actually join office? I have a feeling that once they take office, they will become too busy with day to day stuff and immigration will DEFINITELY become a back-burner issue.
Is it possible to meet the new people moving in after January, now instead of after they take office?
Pls join your PA state chapter first in order to execute the action items. Meeting the lawmakers is one of the action items in the list. we cannot undertake such efforts without enough members in state chapters. pls also urge others you know from your state to join the chapter and get active.

My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

you should not file another perm appl unless it is different job duties. you lawyer should call dol. it takes min of 8 months for perm filed in 07.

My EAD renewal has not been approved and it has been 100 days. I checked with local immigration officer and they dont know as why it is still not processed. USCIS customer service representative says it is within the processing time in Nebraska service center. I efiled EAD and got the biometrics done in June. I am on EAD & can i continue to work if the EAD renewal does not come through befire the current EAD expires ?. Will it affect I485 ?
