Hi,
I have a question. I am on H1 and are planning to extend my H1 along with my wife H4. My question is, we both have EAD's and I never use EAD. My wife is looking for jobs on EAD. If she works on EAD, can she still able to extend H4 status?

As long as she does not work, and she has entered the country using her H4 (as against entering using Advance Parole), she is on H4. Once she uses her EAD, she is no longer on H4. Subsequent US entries will need to be on Advance Parole.

My EAD card was returned as undeliverable as Mail Box didn't have my name on it.
I changed my address and requested the Card to be resent. CSR said it would take 3-5 business days.
I spoke with a IIO today and she said it would take 4- 5 months to get remailed as per their policy.
Which one is right ,CSR/IIO?
Is there anything that I could do to get my card earlier?

Also here is my next question. When my H1B extension is pending, can I change my employer? Should the new employer wait for my H1B that will be renewed or does the new employer apply for a fresh H1B renewal? I guess he cannot do this because I will out of status for 7 months and this might turn out to be illegal. Someone plsssssssss answer my questions!

One of my friends gave me this suggestion - go find some voice over IV. Till Now I was least bothered but because the new anti- H1 B laws are being proposed ( Sen Grassy et all ) , I have to look at this angle. Because without GC , with those new laws in effect, it might be imposs to work here..
Ok , I filed under E B 2 category way back in Ending of 05 and my Labor and 140 got approved.Filed AOS in 2008 ending and since then on the GC wait List.
There are some questions I have which makes me think - is it worth the wait ? IF NOT then lets look at other possibilities including starting some business in Bangalore or going to Canada. I dont know- PL Help me out here friends.
When my employer filed for labor the the promised amt of some $90K in immigrant labor applocation. I could not make that much but I was around $72K Then I had to leave him and go work in UK for the same client ( since that was a UK based company ) and my employer got paid hiring fees. He was not aversive .
So for entire 2007 my income was 0 becos I was in UK working for this MNC and paying UK taxes.
1) Then in 2008 the same client called me back to US but it took some 2 months before they could finally begin my work there and only then my pay started .
So 2008 - I was only close to some $60K PA ( annualized but I was not there entire 2008 . I came back from UK to US around mid 08).
Then on there had been no problem 08 and 09 all gone well.
2 )I read the GC terms and it said - bcos GC is prospective thing, it has nothing to do with your current salary. But in realistic terms - is there chance of problem here ? looking at this ..?
3) If I am in Bangalore after Feb 10, permanently would that be problem in case the lines moves up and I am not in USA ? Will they think that because you are not in US ...and are not working for same employer , cant give GC ..?
Which one can be hurdle in final step 1 , 2 or 3 ? Or God only know

In order to be able to finally adjust status when your priority date become current you must either maintain a continuously valid advance parole or H-1 visa. Alternatively, you could file an I-824 requesting that your approved I-140 be transferred to the National Visa Center so that when your priority date becomes current you can apply at the US Consul in Canada for your immigrant visa.

Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.
But when he filed my h1b i was in india.
i came to us on June 2009 on H4 visa.
can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.

Are you in consulting business. Technically you are supposed to work at the location where you have filed your LC. If you had filed prior to PERM, then you may be fortunate because pre-PREM there was a textarea where the employer could explain about where the beneficary would work. Consulting firms filled out this column in such a way that you could work anywhere in US, but your head office is xxxx. If this is the case then you should not have problems other than filling our AR-11 and sending it to DHS / USCIS.
If it is after PERM, then you do not have any options. I am not sure how consuting firms handle this situation.

There is no FIFO system.. whatever gets picked out of the DUMP gets processed.. I don't think one can draw any conlcusion based on approvals..

I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

My priority date is Dec 2005 and country of chargeability is India. My application and my son's application were approved on August 04, 2010 but my wife's application is still pending approval. 1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".
Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.
PS: If the post helps you, how about contributing a fraction of that $250 to this noble cause :)

Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?
I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!
Please help.

sorry man.. I don't have anything for you. If I were doing it I'd opt to try to create the maze in Flash, using a/s created lines.. but that's not much help to you.
