ravise is absolutely right, u will get H1 for the period remaining (6 years minus time spent on L1). Also, if u file in next year's quota (filing starts in Apr 2010), it cannot have a start date earlier than Oct 1, 2010. I don't think u can start working on H1 before that date, even if u file premium.
Why don't u ask you company to file in current year's quota -- there are still visas available.

I'm getting a visa stamping date in Kolkata embassy but I'm from New Delhi. I dont want to take a chance and wait till the dates in New Delhi embassy are available. Can I schedule interview in Kolkata and later when dates become available in New Delhi change it ? I mean can I change the venue of my appointment ?

Hello, All buddies:
My case is a little special:
After my wife (H-1B) filed I-140/I-485, I got EAD in Dec 2006, and I (H4)started to work by using EAD from Jan 2, 2007. On May 10, 2007, we received I-140/I485 denial letter. we filed a reopen and reconsideration for I-140 denial. I was still using that EAD for work (it is vaild from Dec 2006-Dec 2007) during that time. In November 27. 2007, I changed my visa from H4=>H1.(I was not being asked by USCIS to go aborad for re-stamping H1, anyway it is approved). The USCIS denied our Reopen and Reconsideration for I-140 again later in March 2008.
Now the comany sponsor me to apply for EB2 green card.
Usaually, when using EAD, your status is AOS, and when I-140/I485 denied,
you lose your status. In my case, from May 10-Nov 27, I maybe already lose
my status. however, H4=>H1 is OK without any problem.
My question
1.
I worried that in the future, in the stage of waiting for I-485 approval, does USCIS can find out that I have the above problem between May 10-Nov 27, (it is over 180 days)?!
--However, during that period, I have a I-140 reopen and reconsideration case pending?--does this mean legally staying in US? (even it denied again later)
2.
If this is a problem, do I had better go home country/re-entry US once to clean these mess?
3.
However, I am over 180 days, is that possible that I can not come back?

Your new employer can file an H-1 petition for you, BUT you are not eligible for an extension of H-1 status because you are not currently maintaining H-1 status. In order to resume H status, once company B's petition is approved, you would have to go to a US Consul outside the US, obtain an H-1 visa and then re-enter the US using that visa.

I too support idea of getting Attention of Janet to clear GC backlog.
But instead of letter and FAX (protest mode) , I suggest, IV representatives should take her appointment for 20-30 minutes and explain her Administrative problems to her.
If nothing happens, We should start protest, by sending letters and faxes to gain her attention, but I believe first we do professional presentation and explain what are we talking about!
My main problem with current USCIS administrations are
- Out of order processing of cases (In my opinion case processing should be done strictly by PD)
- Lack of transparency to Visa bulletin decision and numbers.
- Better case status report on USCIS website.

Hi,
I had my last name misspelled and middle name missing on my filed perm labor application and it was filed on 12/12/2007. It was selected for audit in Feb 2008 and have not received any update until now. Can this error in my name be corrected on my application. Please advice.
Sorry to say this, but it was dumb to have sent an application with misspelled last name! You got to check and recheck before filing it.
DOL audits do take a long time, write to them about the error. Also, get the help of an attorney (labor or immigration)

Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

No it is not but the chances of getting a stamp is higher or at least it use to me.
I remember going through the same thing few years back but then economy was not as bad it is today. Always remember the guy's job at US Embassies is to stop people from coming or act like a gate keeper.
Just carry all your supporting documents like:
Tax returns
Offer letter
Letter from the company stating your continuous employment
Pay stubs
Bank statemen
ts and any assets you might have in the US (property, etc.)
Good luck

While parents apply for a tourist visa, in DS-156 where it says "who will pay for the trip", if they mention "self" do we still have to send an Affidavit of Support.
Secondly, do they have to show sufficient cash in their bank account for the trip or will investment proof be ok.
Thirdly, our extended visa is expiring 28thApr'07 & we've applied for renewal in feb'07. We have n't received the receipt yet. Will our current visa copy be sufficient ?

I'm sure you'll be okay. All they want to know is the basis of your eligibility for filing I-485 and choosing (h) and adding this explanation should be fine.

Mine got approved in about 2 months time. My labor certificate reached the lawyer who passed it on to my employer.
I did a big mistake of not asking for a copy and again when I received it while filing I140 - did not make a copy again.
Please save a copy for yourself - it helps a lot while switching jobs during AC21.

The magazine in question is definitely not a major publication, however I think its important to highlight our case wherever possible.
Is there a 'Media Kit' on the lines of "meet your lawmaker kit' ? I looked at the "contact media" link on the home page but could not find anything.
I would be grateful if someone can point me to the relevant material, or if someone is willing to share their experience in talking to the media.
